GAP and insurance on a car lease

GAP (guaranteed asset protection) insurance on a lease covers the difference between what your insurer pays when the car is totaled or stolen and what you still owe the lessor.

If the car is totaled or stolen

GAP covers what your insurer doesn't pay.

Example, round numbers
$44,000The lease payoff: what you owe to close the lease
$39,000What the insurer pays: the car's $40,000 value minus your $1,000 deductible

=

$5,000 short$4,000 of gap plus the deductible. A gap waiver typically cancels the $4,000.

Made-up numbers. Many gap waivers leave the deductible to you, and some optional GAP products cover part of it.

Some captive lenders already build a gap waiver into the lease, including Mercedes-Benz Financial Services and American Honda Finance as of September 2026, so a separate GAP product can mean paying twice. Your lease also sets insurance requirements, and some lessors require far more liability coverage than California's minimum.

What gap insurance covers on a lease

If the car is totaled, or stolen and not recovered, your insurer pays its actual cash value minus your deductible. What you owe to close the lease can be higher, especially early in the term or if an old balance was rolled into the lease. That shortfall is the gap.

Example with made-up numbers: the insurer values the car at $40,000 and pays $39,000 after your $1,000 deductible. The lease payoff is $44,000, so you're $5,000 short: $4,000 of gap plus the deductible. A gap waiver typically cancels the $4,000. Many leave the deductible to you, and some optional GAP products cover part of it.

Gap coverage usually excludes past-due payments, late fees and amounts the insurer deducts for prior damage or missing equipment. It also won't return cash you put down at signing, which is one reason to keep that amount low; see due at signing.

Which lenders include GAP in the lease

These are lender policies as of September 2026, taken from each lender's own website. Policies change, and the contract you sign is what counts.

  • Mercedes-Benz Financial Services: a gap waiver is part of the lease agreement, as long as your insurance is in force and your payments are current when the loss is settled. You still owe your deductible.

  • American Honda Finance (Honda and Acura): says all its leases include GAP, with exclusions and limits set out in the agreement.

  • Audi Financial Services: says its GAP product is not available for purchase on a lease vehicle. Read the total-loss section of your lease to see how a gap is handled.

  • Toyota Financial Services and Lexus Financial Services: sell GAP as an optional product at the dealership on both finance and lease contracts. Check your lease for a gap waiver or a GAP LIABILITY NOTICE before you buy it.

  • GM Financial: describes GAP as an optional product. Its customer FAQ doesn't say whether leases include a gap waiver, so check your contract.

  • BMW Financial Services and other lenders: read the total-loss and gap sections of the contract, and ask the lender to confirm in writing.

How to tell if your lease already has gap insurance

California makes this easy to check. If a lease leaves you responsible for the gap after a total loss, the contract must print a "GAP LIABILITY NOTICE" on the first page stating that you're liable for the gap amount and that optional coverage may be offered for an additional price (Civil Code 2985.8). If you see that notice, the lease doesn't waive the gap. If there's no such notice and the contract includes a gap waiver, a separate GAP product mostly duplicates it.

If you're offered GAP anyway, ask what it costs, what it excludes, whether it covers any of your deductible and how to cancel it. The Consumer Financial Protection Bureau notes that GAP is optional and that you can cancel optional add-on products. From October 1, 2026, California's CARS Act also bars dealers from charging for add-ons you wouldn't benefit from, and its examples include GAP agreements that don't comply with the state's GAP rules and products that provide no coverage for you, the car or the deal (Civil Code 1784.42). See dealer add-ons and junk fees.

Do you need gap insurance on a lease?

  • Your lease includes a gap waiver: you generally don't need a separate GAP product. Ask whether anything covers your deductible.

  • Your lease has a GAP LIABILITY NOTICE: coverage is worth considering, especially early in the term, with little down or with an old balance rolled in. Compare the dealer's GAP with any loan or lease payoff coverage your own insurer sells.

  • You're not sure: ask the lessor in writing before you sign, not after.

California's minimum insurance vs what lessors require

California's minimum liability limits for policies issued or renewed on or after January 1, 2025 are 30/60/15, in thousands of dollars: 30 for injury or death of one person, 60 for injury or death of two or more people and 15 for damage to property (Vehicle Code 16056). The minimums rise to 50/100/25 for policies issued or renewed on or after January 1, 2035.

The lessor owns the car, so the lease sets its own minimums, and your policy has to meet them. As of September 2026, limits in thousands of dollars:

  • Mercedes-Benz Financial Services: liability of at least 100/300/50, comprehensive and collision coverage for the car's actual cash value, and a deductible no higher than 2,500 dollars.

  • GM Financial: bodily injury limits of 100/300, property damage of 50 or a combined single limit, and comprehensive and collision coverage with a deductible no higher than 1,000 dollars.

  • Toyota Financial Services and Lexus Financial Services: the liability minimum of the state where the car is kept, plus physical damage coverage for the car's full value with a deductible no higher than 1,000 dollars.

  • Audi Financial Services: the required coverage is listed on the back of the lease contract, with VW Credit Leasing, Ltd. named as additional insured and loss payee.

Lessors typically also require your policy to name them as additional insured and loss payee, using the exact name and address in your contract, so expect the dealer to ask for proof of coverage before delivery. California lease contracts also warn that liability and property damage coverage isn't included unless the lease charges for it (Civil Code 2985.8), so the policy is yours to arrange. The DMV lists the state's rules on its insurance requirements page.

What happens if your leased car is totaled or stolen

  1. Report it and keep paying. Tell your insurer and your lessor right away, and keep making payments until the lessor confirms the account is settled. American Honda Finance, for example, tells lessees to continue their payments and contact customer service.

  2. The insurer pays the lessor. As owner and loss payee, the lessor receives the settlement, and the lease ends early.

  3. Gap coverage is applied. If the lease includes a waiver or you bought GAP, the shortfall is waived or paid, subject to its exclusions.

  4. You settle what's left. Usually your deductible, any past-due payments and fees. A refundable security deposit is applied to what you owe or returned.

If the loss happens early, compare what's left with what ending a lease early would have cost; the gap is the same idea, which is why coverage matters most in the first year or two.

Before you sign: what to ask

  • Does this lease include a gap waiver, and is there a GAP LIABILITY NOTICE on page one?

  • If GAP is offered separately, what does it cost, what does it exclude and how do I cancel it?

  • Does anything cover my deductible after a total loss?

  • What liability limits and maximum deductible does the lessor require?

  • What exact name and address go on my policy as additional insured and loss payee?
